As a Community Interest Company, we operate for community benefit. Any surplus from sales and donations is reinvested in our stated community purposes rather than distributed for private profit.

These Terms and Conditions ("Terms") govern your use of the Website and any purchase or donation you make through it. By using the Website, placing an order, or making a donation, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order or make a donation on the Website.

3. Products

  • We sell mushroom-related products, including but not limited to grow kits / cultures / substrates / dried mushrooms/ books/ mushroom art (the "Products").

  • We make reasonable efforts to display Products, descriptions, and prices accurately. Colours, sizes, and appearance may vary slightly from images shown, particularly for natural/organic products.

  • Product availability is not guaranteed. If an item you have ordered is out of stock, we will contact you to offer a substitute, refund, or delay in dispatch.

  • Some products (such as live cultures or grow kits) may be perishable or seasonal, and their viability may depend on correct handling and storage by the customer after delivery.

4. Orders and Contract Formation

  • Adding items to your basket does not constitute an order.

  • When you place an order, you will receive an order confirmation email. This confirms we have received your order but does not mean we have accepted it.

  • A binding contract is formed only when we dispatch your order (or confirm dispatch by email).

  • We reserve the right to refuse or cancel any order, for example due to stock unavailability, pricing errors, or suspected fraud. If we cancel an order after payment has been taken, we will issue a full refund.

5. Prices and Payment

  • All prices are shown in GBP (£), we are not Vat registered.

  • Delivery charges are shown separately at checkout before you complete your order.

  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

  • Payment is taken at the time of order via the following methods:

  • Debit/credit card (processed securely through our website payment provider on the Wix platform)

  • PayPal

  • We do not store your full card details. Card payments are processed securely by our payment processor(s); PayPal payments are processed by PayPal in accordance with PayPal's own terms and privacy policy.

  • If a payment is declined or fails, your order will not be processed.

6. Delivery

  • We currently post and deliver within the United Kingdom only. We are unable to ship orders to addresses outside the UK.

  • Estimated delivery times will be shown at checkout or in your order confirmation. These are estimates only and not guaranteed.

  • Risk in the Products passes to you upon delivery. Title (ownership) passes once we have received payment in full.

  • If you believe your order has not arrived within a reasonable time, please contact us at info@mycobee.org.

  • It is your responsibility to provide a complete and accurate delivery address. We are not responsible for failed deliveries caused by incorrect address details provided by you.

7. Your Right to Cancel (Consumer Contracts Regulations)

If you are a consumer buying from us online, you generally have the right to cancel your order within 14 days of receiving your goods, without giving a reason, under the Consumer Contracts (Information, Cancellation and Charges) Regulations 2013.

Exceptions to the right to cancel – this right does not apply to:

  • Goods made to your specification or clearly personalised;

  • Goods which are liable to deteriorate or expire rapidly (e.g. fresh mushrooms, live cultures, or perishable grow kits) once delivered;

  • Sealed goods which are not suitable for return for health protection or hygiene reasons, if unsealed after delivery.

To cancel, contact us at info@mycobee.org within 14 days of receipt. You must return the goods (where applicable) at your own cost, in a resalable condition, within 14 days of telling us you wish to cancel. We will refund you within 14 days of receiving the returned goods, using the original payment method.

8. Faulty, Damaged, or Incorrect Items

If an item arrives faulty, damaged, or is not what you ordered, please contact us at info@mycobee.org within a reasonable time, ideally with photographic evidence. Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms — goods must be of satisfactory quality, fit for purpose, and as described.

9. Donations

  • We are a not-for-profit Community Interest Company and gratefully accept voluntary donations through the Website.

  • Donations are non-refundable except in cases of processing error (e.g. duplicate or incorrect charge) or where required by law.

  • Donations do not entitle the donor to any goods, services, or membership rights unless explicitly stated at the point of donation.

  • As a Community Interest Company (not a registered charity), we are not able to claim Gift Aid on donations.

  • Donations are processed via the same secure card and PayPal payment methods used for purchases.

10. Use of the Website

You agree not to:

  • Use the Website for any unlawful purpose;

  • Attempt to gain unauthorised access to the Website or its systems;

  • Post or transmit any harmful, offensive, or infringing content via any interactive feature of the Website;

  • Use automated systems (bots, scrapers) to access the Website without our permission.

We may suspend or terminate your access to the Website if we reasonably believe you have breached these Terms.

11. Intellectual Property

1. Who We Are

As a Community Interest Company (CIC), we operate under an asset lock: our assets and any surplus funds — including donations — must be used for the benefit of the community we serve, rather than distributed for private profit.

2. About Donations

We welcome voluntary donations made through our Website via card or PayPal to support our community mushroom-growing, education, and sustainability activities. Donations are given freely and are separate from any purchase of goods.

3. How Donations Are Used

Donations support our community purposes, which may include:

  • Community mushroom-growing workshops and events;

  • Educational resources about fungi, sustainable growing, and mycoremediation;

  • Running costs associated with our activities at Granton Castle Walled Garden and elsewhere;

  • Running costs associated with website and social media.

We are not obligated to allocate a specific donation to a specific project unless expressly agreed with the donor in writing.

4. Important: We Are a CIC, Not a Registered Charity

MycoBee Mushrooms C.I.C. is a Community Interest Company, not a registered charity. This means:

  • We are not able to claim Gift Aid on donations, as Gift Aid is only available to donations made to registered charities and Community Amateur Sports Clubs (CASCs).

  • Donations to us are not tax-deductible in the way a charitable donation might be.

  • Our community benefit and asset lock are regulated by the CIC Regulator, not the Charity Commission.

5. Refunds on Donations

Donations are generally non-refundable, as they are given voluntarily and not in exchange for goods or services. However, we will provide a refund where:

  • A payment was made in error (e.g. duplicate transaction or incorrect amount);

  • There has been a technical processing error;

  • We are required to do so by law.

If you believe you have made a donation in error, please contact us at info@mycobee.org as soon as possible, ideally within 14 days, quoting your payment reference.

6. Payment Processing

Donations are processed securely via the same card and PayPal payment methods used for purchases on our Website, which is built on the Wix platform. We do not store your full card details. See our Privacy Policy for details on how we handle your personal and payment data.

7. Anonymous and Named Donations

You may choose to donate anonymously where the payment platform allows this. What This Means

A Community Interest Company is a special type of limited company that exists to benefit the community, rather than private shareholders. As a CIC, we are:

  • Subject to an asset lock, meaning our assets and profits must be used for the benefit of the community we serve, and cannot be distributed for private gain;

2. Cultivation Outcomes Are Not Guaranteed

Mushroom growing involves natural biological processes. While we take care in preparing and supplying grow kits, spores, and cultures, we cannot guarantee:

  • Successful germination, colonisation, or fruiting;

  • A specific yield or harvest size;

  • That results will match photographs or descriptions exactly, as natural products vary.

We are not liable for failed grows caused by factors outside our control, such as incorrect handling, unsuitable growing conditions, temperature, humidity, or contamination introduced after delivery.

Where we provide foraging guidance, ID cards, or workshop content, this is provided for educational purposes only. We are not responsible for any harm resulting from misidentification or consumption of wild fungi. Always forage responsibly, follow the Scottish Outdoor Access Code, and verify identification with multiple trusted sources or an expert before consuming any wild mushroom.
